Seller Terms

Platform Relationship
The seller is an independent business using ArtListings under its own identity. ArtListings is not an agent, distributor, employer, reseller, or seller of record for the seller.
The seller is solely responsible for all commercial and legal aspects of its listings and transactions.
Acceptance Of Terms
By registering, logging in, onboarding, publishing listings, using seller tools, using an ArtListings or Artimin account, or otherwise using ArtListings services as a seller, the seller accepts these Seller Terms to the extent legally permitted.
If ArtListings publishes updated Seller Terms, continued use of the services, continued account access, continued listing activity, or continued publication after the effective date of the updated terms constitutes acceptance of those updated terms to the extent legally permitted.
Seller Responsibility
The seller is fully responsible for:
listings and uploaded content
pricing, taxes, and invoicing
stock and availability
order acceptance and fulfillment
shipping, delivery, insurance, import, export, and customs
returns, refunds, withdrawal rights, conformity, warranty, and complaints
compliance with consumer law, tax law, and other applicable laws
Pricing Rules
The seller must enter the exact selling price for each artwork that may be sold through ArtListings.
The seller must enter that price in the correct listing or transaction currency used for the artwork or offer.
New listings should in principle be priced.
Price on requestmay remain available only as a limited legacy exception where operationally necessary.ArtListings may fetch reference exchange rates on a daily basis and may automatically convert and display seller prices in other currencies for convenience.
Unless ArtListings expressly states a different checkout or payment currency, any auto-converted display price is indicative only and the seller-entered price in the stated transaction currency prevails.
ArtListings is not liable to the seller for exchange-rate fluctuations, rate timing differences, third-party payment-provider or bank conversion rates or fees, or minor rounding or conversion differences.
The seller is responsible for the correctness of standard prices, custom offer prices, and custom shipping prices.
The seller must keep pricing and availability current.
ArtListings is not liable for errors, mismatches, losses, or disputes caused by incorrect seller pricing or stock information.
Stock And Availability
The seller must not offer unavailable objects as available.
The seller is responsible for making sure stock, reservation status, and prior sales are correctly reflected.
Messaging And Offers
The seller may use messaging tools to communicate with buyers.
The seller may send offers through messaging, including a custom artwork price and a custom shipping price.
Every such offer is the seller's offer and remains the seller's responsibility in terms of correctness, enforceability, and performance.
Response Standards
Sellers must respond to buyer messages, price suggestions, order-related communications, and similar requests without undue delay.
Sellers must handle leads, negotiations, orders, cancellations, complaints, and follow-up requests promptly and professionally.
Repeated late responses, ignored requests, or poor handling may lead to reduced visibility, lower trust signals, warnings, feature limitations, moderation measures, suspension, or termination.
Ratings, Reviews, And Performance Metrics
ArtListings may collect, calculate, store, analyze, use, and display seller ratings, reviews, complaint signals, response times, response rates, completion signals, cancellation signals, and other seller-performance data.
Where legally and contractually permitted, ArtListings may also import, reference, aggregate, summarize, or display ratings, reviews, review counts, badges, or similar reputation signals relating to the seller from Google or other third-party services.
ArtListings may use such data for ranking, visibility, badges, trust signals, seller insights, moderation, support, quality control, fraud prevention, product improvement, and other platform purposes.
ArtListings may display such data publicly or privately on websites, apps, seller accounts, internal dashboards, emails, or other platform surfaces.
The seller is responsible for ensuring that any third-party account, profile, or review source it connects or claims is accurate and that it has the necessary rights or permissions to authorize such use where required.
ArtListings is not liable for reduced visibility, reputational effects, lost sales, or other adverse consequences resulting from the display or use of seller ratings, reviews, response-time indicators, or similar performance metrics, except to the extent caused by wilful misconduct or where liability cannot be excluded under mandatory law.
Seller Terms And Shipping Terms
The seller may publish additional buyer terms, shipping terms, delivery conditions, return instructions, or similar transaction terms through its ArtListings or Artimin account, storefront, listing flow, messaging flow, or checkout-related surfaces.
Any such terms are the seller's terms, not ArtListings' terms, and remain solely the seller's responsibility.
The seller must ensure that any additional terms are lawful, accurate, current, internally consistent, and clearly disclosed to the buyer before the transaction is concluded.
The seller is solely responsible for conflicts, omissions, unenforceable clauses, or legal non-compliance in seller-provided buyer terms or shipping terms.
Order Refusal Or Cancellation
The seller may refuse, reject, or cancel a transaction only where legally permitted.
Examples include incorrect stock, prior sale, loss, damage, obvious pricing error, fraud risk, sanctions risk, or legal/compliance concerns.
If the seller refuses or cancels an order, the seller remains fully responsible for buyer communication, repayment where required, and any legal obligations toward the buyer.
Screening And Fraud Prevention
The seller is solely responsible for screening buyers, leads, orders, pickup requests, shipping arrangements, payment confirmations, proof-of-payment messages, intermediaries, and other transaction-related communications for fraud, sanctions, export-control, money-laundering, or other compliance risks.
The seller must use appropriate care before releasing an artwork, confirming pickup, accepting payment evidence, shipping, or otherwise completing a transaction.
ArtListings may provide messaging tools, warnings, flags, or trust and safety features, but does not undertake seller-side due diligence, KYC, payment verification, fraud screening, or transaction monitoring on the seller's behalf unless expressly agreed in writing.
ArtListings is not liable for scams, phishing, impersonation, forged payment confirmations, fake pickup agents, fake shippers, social engineering, chargebacks, sanctions evasion, or other fraudulent or criminal conduct by buyers or third parties.
Complaints, Claims, And Notices
ArtListings may forward to the seller, in full or in part, any buyer complaint, demand, claim, dispute, chargeback notice, payment dispute, legal notice, authority inquiry, platform report, or other communication relating to the seller, its listings, its conduct, or a transaction.
The seller must handle such matters promptly, directly, and at its own expense where applicable, and must provide timely substantive responses, documentation, and cooperation where reasonably requested.
ArtListings is not obliged to investigate, decide, settle, defend, or resolve such matters on the seller's behalf.
The seller remains solely responsible for the underlying transaction, the legal position taken toward the claimant, and any refund, defence, settlement, compensation, compliance step, or follow-up arising from such matter.
Content Quality And Rights
The seller must upload lawful, accurate, original, and sufficiently high-quality content.
The seller must use images and materials it is entitled to use.
Required product information may include accurate descriptions, condition, dimensions, material, period, origin, taxonomy, and freestanding imagery where required.
The seller remains owner of its own content.
The seller grants ArtListings a broad, worldwide license to host, display, copy, translate, adapt, format, distribute, promote, archive, and reuse listing and artwork content for platform, editorial, newsletter, social media, SEO, advertising, and marketing purposes.
Editorial, Newsletter, And Social Use
ArtListings may use listing data, artwork data, images, text, and seller names in newsletters, social media posts, redactional selections, and marketing campaigns.
ArtListings decides what appears in its newsletters, social channels, and promotional formats.
Sellers cannot require that a piece of content remains included, is excluded, is changed, or is restored, except where required by law.
External Channels And Google Shopping
ArtListings may use, format, adapt, syndicate, export, and submit seller listings, artwork data, prices, images, seller names, and related listing content to Google Shopping and other third-party discovery, advertising, comparison, feed, marketplace, or commerce channels.
ArtListings may decide in its own discretion which listings, sellers, or categories are included, excluded, prioritized, paused, or removed from such channels.
ArtListings does not guarantee acceptance, visibility, ranking, traffic, leads, or sales from Google Shopping or any other external channel.
The seller remains solely responsible for the legality, accuracy, completeness, and currency of all submitted listing content and for compliance with applicable law in relation to the listed objects.
The seller must ensure that its listings, images, descriptions, prices, and other content may lawfully be used for such channel distribution and promotion.
ArtListings is not liable for rejection, suspension, disapproval, limited visibility, account or feed issues, third-party policy enforcement, or losses arising from the use or non-use of Google Shopping or other external channels.
Platform Freedom
ArtListings may add, change, limit, suspend, replace, or remove products, services, widgets, backend features, workflows, integrations, and messaging tools at any time.
This includes features such as shipment tracking, payment widgets, order tools, inbox tools, pipeline tools, statistics, admin features, checkout flows, messaging widgets, AI features, analytics tools, captcha or anti-bot tools, consent tools, and future modules.
Sellers only receive a right to use the platform and services as made available from time to time.
Sellers cannot demand that a feature remains available, returns, stays free, or works in a specific way.
ArtListings is not liable for revenue loss, missed leads, indirect damage, or other losses resulting from changed, removed, limited, or unavailable features or services.
Payment And Rate Changes
Sellers must pay subscriptions, service fees, usage fees, AI fees, and any other agreed charges on time according to the agreed plan.
ArtListings may change rates, subscription fees, AI rates, and other service charges effective from a next contract, subscription, or billing period.
ArtListings may apply annual indexation.
ArtListings may also apply additional commercial price changes on top of indexation.
Publication or notice by ArtListings is sufficient for such changes unless mandatory law requires more.
If payment remains overdue after reminder, ArtListings may suspend or deactivate accounts, listings, backend access, or features until payment is completed.
ArtListings is not liable for damage, lost turnover, or data loss caused by suspension or limitation due to non-payment.
AI Fair Use
AI features are subject to fair use.
ArtListings may log AI usage, prompts, volumes, events, and related account activity for security, support, analytics, abuse prevention, and billing.
In cases of excessive or disproportionate use, ArtListings may throttle usage, temporarily block access, or apply additional charges.
ArtListings may reasonably determine when use qualifies as excessive or abusive.
Security, Login, And 2FA
Sellers must keep credentials, mailbox access, login links, devices, and internal account access secure.
Backend access may require mandatory email-code 2FA.
Sellers must comply with such security requirements and promptly report suspected misuse or incidents.
Backups And Data
ArtListings may make backups for continuity, recovery, security, migration, and disaster recovery.
Backups are an internal safeguard, not a guarantee of complete, error-free, or immediate recovery.
ArtListings is not liable for data loss, corrupted data, incomplete restores, delayed restores, or resulting damage.
Sellers remain responsible for keeping their own essential business, order, and content records where needed.
Moderation, Suspension, And Termination
ArtListings may hide, limit, suspend, deactivate, or terminate listings, tools, or accounts in cases including:
poor or misleading content
incorrect imagery
pricing or stock issues
persistently slow response times or ignored buyer requests
poor ratings or repeated complaint signals
IP infringement
fraud
sanctions or terrorism-related risk
security risk
non-payment
legal or compliance demands
reputational or quality concerns
Indemnity And Liability
The seller indemnifies ArtListings against claims arising from seller content, prices, offers, stock information, shipping information, transactions, cancellations, seller-provided buyer terms or shipping terms, legal non-compliance, or other seller conduct.
The seller has no right to claim compensation for lost revenue, indirect loss, or consequential damage resulting from platform measures, downtime, hacking, feature changes, price issues, sync issues, non-payment suspension, or data loss.
To the extent enforceable, ArtListings' direct contractual liability toward a seller is capped at
EUR 500.
